17. Recidivism

While Carlos DeLuna waited on death row, Carlos Hernandez was arrested nine times. He remained a phantom with regards to the Wanda Lopez case, but he certainly wasn’t keeping a low profile. Two of his arrests involved the use of deadly force against a Hispanic woman: the murder of Dahlia Sauceda, and the stabbing of a woman named Dina Ybañez.

Unlike Dahlia and Wanda, Dina survived the night in April 1989 that Hernandez stabbed her in the stomach and then tried to rape her. Hernandez was caught and arrested, but his lawyer, Jon Kelly, procured a reduced sentence for him in exchange for a guilty plea. Hernandez was in prison for only nineteen months before he got out on parole.

After 1989, Hernandez’s drunk, violent luck continued until September 1996, when he was assigned his first female parole officer. She was less willing to overlook his behavior, and Hernandez’s parole was revoked when he was arrested on another knife-related charge (he threatened neighbors with a nine-inch blade). By this time, his health was deteriorating, and on May 6, 1999, he died from cirrhosis of the liver and was buried in a pauper’s grave on prison grounds.

Need to Know: Hernandez never stopped committing crimes, but he was only sometimes arrested and almost never imprisoned. Even when he stabbed Dina Ybañez with his signature buck knife, he managed to receive a reduced sentence because Jon Kelly tricked Dina into signing an agreement that claimed the stabbing was an act of passion during a lover’s spat.
